Wright City man charged with fraudulent use of a credit device

Joshua Avery, 38, of Wright City, was charged with two counts of the fraudulent use of a credit or debit device, one a felony and one a misdemeanor, stemming from incidents in early-April. 

On April 15, officers responded to a witness stating someone had gained access to his credit card account and had attempted to make purchases, according to a probable cause statement filed by Wright City Detective James Holmes. 

The witness’ credit card was reported lost or stolen on March 23 despite the witness making no such reports, and the witness received two cards in the mail, one with his name and one with Avery’s name, bearing the same card number. 

According to the probable cause statement, Avery attempted five withdrawals at two different locations in Wright City between April 2 and 3 totaling roughly $2,500. 

A separate witness provided security footage from the American Bank of Freedom in Wright City displaying Avery using their drive-up ATM to attempt to make the withdrawals. 

On April 17, Wright City Police Officer Jose Malta located Avery and found two credit cards in his wallet, one bearing the victim’s name and one bearing his own with the same number. 

A warrant was served for his arrest and he is to be held on a $10,000 bond.
