A Warrenton man described as a foreign national illegally residing in the United States was taken into custody Thursday for allegedly raping a female victim.
Jan Kawa, 25, of the 19000 block of Royal Drive, was charged with first-degree rape, second-degree domestic assault and first-degree harassment, all felonies. He was taken into custody after being located hiding under a table with a blanket in the basement of a home in Montgomery County, according to the Warren County Sheriff’s Department.
Detectives started investigating the sex case on April 10. According to the probable cause statement filed by Detective Dean Jackson, the victim stated Kawa prevented her from leaving the bedroom while raping and assaulting her.
The victim spoke with Kawa via text message during the investigation at which point he admitted to to the rape allegation and apologized for his actions, according to the probable cause statement. He also threatened the victim saying he would release lewd photographs of her if she did not speak with him, the probable cause statement shows.
Jackson reported Kawa did not deny these actions during an interview with investigators.
Kawa is on probation for second-degree domestic assault, resisting arrest for a felony, felony drug charges and endangering a correctional employee, according to the probable cause statement.
Prior to his arrest, Kawa had been hiding from law enforcement as he also had two active felony arrest warrants for failure to appear. At the time Kawa was taken into custody, a friend showed up at the Montgomery County residence and explained to police that Kawa had requested a ride to Chicago.
The probable cause statement noted Kawa’s visa had expired and he is a foreign national illegally residing in the United States. If he is released from custody, he will be detained and deported by US Immigrations and Customs Enforcement, prevention prosecution, the detective said.
