Innsbrook board postpones vote on ordinance regulating septic lagoons

The Innsbrook Board of Trustees voted to table a decision on an ordinance that would regulate septic lagoons within the village limits during their Nov. 12 meeting. 

The ordinance would prohibit septic lagoons on non-residentially zoned properties and on any property including residentially zoned properties less than three acres. 

The ordinance comes in the wake of heated discussions surrounding the amended site plan of the Wags and Whiskers Animal Shelter that included a septic lagoon on the commercially zoned lot. 

Those conversations consumed several Innsbrook public meetings earlier this year with proponents claiming that the village ordinances did not specifically prohibit septic lagoons. 

The language of the ordinance defines a septic lagoon “as any inland, uncovered body of water connected to a septic tank or other feeding source that is used for, or was designed for the treatment of sewage or wastewater, including any man made supporting structure for the containment of such sewage or wastewater.”

Prior to the meeting, the board held a public hearing on the ordinance. During that hearing Michael Caton spoke up about what he saw as discrepancies in the ordinance’s references to the village’s zoning code. 

“On page two in section two, you have section A1.2 of the village of Innsbrook zoning appendices, but that section doesn’t exist,” said Caton. 

He also noted several other missing sections, or references to sections that were missing information, as well as one instance referring to DNR regulations that he also said he could not find. 

There were at least two references in the ordinance that referred to points in the zoning code that did not exist. 

“I think you probably need to table that and fix these things and then raise it at the next meeting,” said Caton. 

Under the advisement of Village Attorney Chris Graville and Village Planner Todd Streiler, the board decided to table a vote on the ordinance following its first reading. 

“We’d like to double check those references, so if you would consider postponing your final passage until the next meeting, Todd and I are comfortable making sure we got that right,” said Graville. 

The board will have another opportunity to make a decision on the ordinance at their Dec. 10 meeting.
