Rules for UTVs on county roads get an update

The Warren County Commission this week approved new regulations regarding the operation of utility vehicles (UTVs) and other small recreational off-highway vehicles, often referred to as side-by-sides, on county roadways.

Although the county government has been generally permissive of UTVs as the vehicles have gained popularity, the new regulations clarify the rules and expectations for safe and legal operations of the vehicles on county roads. Operating the vehicles is generally allowed under the conditions set forth in an ordinance the county commission approved on June 7 to establish the new regulations.

It’s important to note that the new rules for UTVs don’t apply to any state roadway in Warren County, meaning all of the lettered and numbered highways. The ordinance also doesn’t have any effect within the municipal boundaries of a city government.

“Any person who elects to operate any such vehicle on state or city roads, highways, streets or alleys assumes the responsibility of being knowledgeable regarding the legality of operating off-road vehicles on such roads,” the county ordinance states.

Also important to note is that although the ordinance allows the operation of UTVs, it explicitly bans the use of straddle-style ATVs and low-speed golf carts on county roads.

Here’s a summary of the new rules for UTV drivers on county roads:

• UTV operators must have a valid driver license.
• UTV drivers must abide by normal traffic regulations for vehicles.
• The vehicle must be specifically insured, with proof of insurance kept in the vehicle at all times.
• UTVs without a roof must have a 7-foot bicycle safety flag that meets specifications for size and color. UTVs with a roof must have a reflective device attached to the rear of the vehicle.
• No one is allowed to drive recreational vehicles through any stream unless that stream is on their property, or in certain other cases with the landowner’s permission.
• No driver may operate a UTV while intoxicated, or in an otherwise careless and dangerous manner.
• UTVs may not carry more passengers than they are designed for, or any passenger under 16 unless their parent or guardian is the driver. Age- and size-appropriate child restraints must be in use.
• No pre-inspection or special permit is required to drive a UTV on county roads. However, vehicles on the roads must be equipped with a number of safety features, including headlights, taillights and stop lamps, rear reflectors, parking brake, seat belts, four wheels, and a flag if necessary.
