A St. Charles County Sheriff’s deputy convicted of felony burglary stemming from a controversial 2009 drug raid in Montgomery County has filed a motion for appeal to the Missouri Supreme Court.Last month the Missouri Court of Appeals reversed the deputy’s felony conviction in the case but upheld a misdemeanor assault charge.Last week, attorneys for the deputy, Christopher Hunt, filed a motion for a rehearing before all members of the appeals court or, in the alternative, a transfer to the Missouri Supreme Court on the assault conviction.If that conviction stands, it could disqualify the deputy from serving as a law enforcement officer.The appeals court remanded the case for a new trial on the burglary charge ruling that improper jury instructions were used in the case.Montgomery County Prosecuting Attorney Nathan Carroz told The Record he was going to wait to make a decision to retry the case until the appeals process had concluded.The polarizing case which pitted police officer against police officer in court has drawn national attention. Three former Missouri Supreme Court justices are representing Hunt in his appeal.Warren County Sheriff’s deputies participated in the raid and testified against Hunt at his trial. That caused a rift between the St. Charles and Warren County sheriff’s departments that continues today, according to officials with both departments.St. Charles deputy files appeal
