A man involved in a late night disturbance in Truesdale early Thursday tried to shoot a sheriff’s deputy with his own gun, according to authorities.The alleged assault happened around 1 a.m. Thursday. Jason L. Green, 38, of Phelps County, was arrested and charged with first-degree assault on a special victim and disarming a peace officer performing official duty. He is being held at the Warren County Jail without bond until he appears before a judge.The deputy was responding to a peace disturbance on Smith Street in Truesdale when he encountered Green, who reportedly became agitated.According to an arrest report, Green pushed the deputy, starting a struggle during which the deputy attempted to put Green under arrest.During the altercation, Green allegedly removed the deputy’s department-issued Glock 17 9mm handgun from its holster and attempted to shoot the deputy in the head. The deputy grabbed the barrel of the gun to keep it pointed away, and caused the weapon to malfunction after firing.Green also reportedly bit the deputy on his right ear.Warrenton police officers came to the scene in response to the gunshot and assisted in subduing Green, said Sheriff Kevin Harrison.The deputy involved had only superficial injuries, Harrison said. Green also was not seriously injured.The assault charge against Green is a class A felony. If convicted, he could face a minimum of 10 years in prison. The maximum penalty for a class A felony is 30 years or life in prison.Green has an arraignment scheduled for March 28 in Warren County Circuit Court.
