Innsbrook trustees last week broached the possibility of banning short rentals of certain homes in the village.

A proposed ordinance discussed by the board would ban short-term rentals (30 days or less) of single-family homes. It would also have restricted residents who occupy a single-family home from renting out space in that same home.

The proposal is the latest in a long-running discussion of how to limit excessive noise and other nuisances, which some residents blame on vacation rental properties that work with services such as Airbnb.

After receiving a mix of feedback from more than 30 property owners, trustees decided not to vote on the proposal at their Aug. 11 meeting. But Trustee Cynthia Bowers said this is a conversation she plans to continue until there is some resolution.

“The question is, what do we need to do as a community to help safeguard the peace, tranquility and general welfare of the community,” Bowers told The Record. She said some property owners are in favor of restrictions, while others who also own houses and chalets in Innsbrook for the explicit purpose of renting them out do not want restrictions.

“Everywhere I go in the community, one of my constituents is coming up, sharing issues related to noise, to front yards looking like parking lots, to homes being advertised for use by 22 people,” Bowers said. “Right now we’re looking at all input and trying to decide what is right for the community.”

Trustee Trish Dunn said she understands some of the complaints, but would rather address bad behavior directly when it happens, rather than blaming and restricting renters.

“It’s a behavioral issue that probably could be better addressed through rules and regulations that are already in place being enforced. How that would happen will be the question,” Dunn said.

Dunn added that it’s hard to prove that renters are always the ones who cause issues of noise, misconduct or even littering.

“When there’s trash on the road, how are you to know how it got there? If someone’s driving recklessly, how are you to know if they’re a resident or a renter?” Dunn asked.

Jeffry Thomsen, chairman of the board of trustees, said he hopes over the next month village leadership and the heads of Innsbrook Corporation will be able to work together on a solution that doesn’t require a restrictive ordinance.

“We postponed (the ordinance) to give both the Village Board of Trustees and the Innsbrook Resort time,” Thomsen said. “I think there are people who are in favor of the village enacting legislation to control or ban short-term rentals, and people against it.”

If an alternate solution isn’t reached, the board has scheduled to revisit the rental ban proposal at its Sept. 8 public meeting. Thomsen said the meeting would only include a first reading of the ordinance at most, and that any final vote from the board would take place at the following monthly meeting.
