A southern Warren County man faces a felony charge after an allegation that he performed a sex act on a woman who was passed out after a party in 2016.Charles L. Labelle, 46, is charged with first-degree sodomy, a felony with a minimum sentence of five years in prison if he is convicted. A warrant for his arrest includes a $100,000 bond.The woman who reported the sexual assault contacted the Warren County Sheriff’s Department the day after a late night party at Labelle’s residence on Highway 94 near Marthasville, according to the sheriff’s department.The woman told law enforcement that Labelle had provided alcohol for the party, and that at some point she passed out. Early that morning when she awoke, the victim alleged her clothing had been pulled down and Labelle was performing a sex act on her.The woman’s clothing was submitted to the Missouri State Highway Patrol Crime Lab for analysis.During a police interview, Labelle denied having any relations with the victim. A DNA sample was collected from him and submitted to the crime lab.The sheriff’s department didn’t receive DNA test results until April 4, 2017, according to the report. The highway patrol crime lab reported that DNA found on the clothing was consistent with Labelle and the victim.A detective interviewed Labelle again July 13, 2017. Labelle allegedly stated that he and the woman kissed and touched each other, but that nothing further occurred.Missouri law defines first degree sodomy as any deviate sexual intercourse with a person who is incapacitated, incapable of consent or lacks the capacity to consent, or by the use of forcible compulsion.Missouri online court records and the state sex offender registry do not show any previous criminal charges associated with Labelle.Crime
