A Warrenton man who was charged with involuntary manslaughter in a crash that killed his father will serve 60 days’ shock time in jail.Mark D. Laney, 32, pled guilty Tuesday to the felony charge in Warren County Circuit Court in connection with the 2012 one-car accident that killed Rex Laney, 50, of Moscow Mills, who was a passenger in the vehicle.Judge Wesley Dalton gave Laney a seven-year sentence that was suspended. He must serve five years’ probation, perform 100 hours of community service and install an alcohol ignition interlock on any vehicle he drives.According to the Missouri Highway Patrol, Laney was driving a 1997 Cadillac southbound on Highway 47 and lost control when he failed to negotiate a curve. The car crossed the centerline, ran off the left side of the road, through a ditch and overturned.Rex Laney was ejected when the car overturned. He was pronounced dead at the scene by Roger Mauzy, Warren County coroner.Officers reported that Mark Laney was “unsteady on his feet” and that they smelled alcohol on his breath. His speech also was slurred, according to a probable cause statement.According to troopers, Laney admitted that he had been drinking earlier with his father at the VFW hall in Warrenton. He refused to take a field sobriety test, citing injuries he sustained in the accident. He did admit that he drank too much to be driving, according to the statement.Warren County Prosecuting Attorney Mike Wright said Laney had a blood alcohol level of .162 percent, according to a blood test taken several hours after the crash. That is more than twice the legal limit for a DWI violation. Laney also tested positive for marijuana in his system, authorities said.“The disposition of this case is consistent with what my office has recommended in the past in these types of cases where the decedent was a passenger in the car,” Wright said Wednesday. “The family was not wanting prosecution and we do take that into consideration.”The accident occurred on southbound Highway 47 north of South Bend Road.Man sentenced in fatal crash
