Jury Finds Minicky Guilty of Statutory Sodomy

A Warrenton man accused of inappropriately touching a 10-year-old girl in 2003 was found guilty last week. Mark Minicky, 23, who was 17 when the crime was committed, was convicted of felony statutory sodomy with a person under the age of 14. The jury of eight women and five men also recommended Minicky receive 10 years in prison for the crime. A formal sentencing hearing has been scheduled for Jan. 5, 2009, in front of 12th Judicial Presiding Judge Keith Sutherland. Minicky could be sentenced anywhere from a minimum of 10 years to life in prison, according to Prosecuting Attorney Mike Wright. The victim, now 16, took the stand last Thursday and testified that Minicky touched her inappropriately while staying at the residence with a friend, the same residence where Minicky lived in Prairie Estates subdivision during the summer of 2003. She said when she dozed off as they were watching a movie, Minicky carried her to his bedroom for a short time and then to his sister's room. It was in her friend's room where the incident occurred. She said Minicky touched her and rubbed against her. Minicky stopped when another person, who had been taking a shower, stepped into the room, according to the victim's testimony. Though she never opened her eyes during the time she was with Minicky, the victim said she recognized Minicky's voice. She stated she didn't tell anyone of the incident until two years later because Minicky was her brother's best friend and didn't want to hurt their relationship. Minicky never took the stand at last week's trial. He was represented by Washington attorney Steven Weir, who argued that Minicky was coerced into making a false statement to Doug Stonebarger, a lieutenant with the Warren County Sheriff's Department. Weir also said that since the victim never opened her eyes she could have been dreaming. When Stonebarger testified Friday, he recalled interviewing Minicky who told him that he slept in the nude and may have swung his arm over the victim while sleeping in the same bed. The trial didn't wrap up until around 10 p.m. Friday as slow progress was made throughout the second day. Last week's trial was held more than a year after a mistrial was declared April 21, 2008, due to comments made by Weir during his opening statement. The judge ordered Weir to pay $1,023.18 to cover jury costs.
