Judge suing attorney for 2014 crash

Warren County Judge Richard Scheibe is suing local attorney Tim Joyce and another local man for injuries Scheibe alleges are the result of a 2014 vehicle collision.Scheibe, 48, is an associate judge for the 12th Circuit Court in Warrenton. He claims that Joyce, 65, and Darrell Meine, 38, both of Warrenton, acted negligently as the drivers of vehicles in a 2014 crash in which Scheibe was a passenger.Joyce has worked over three decades as an attorney in Warren County. He currently serves as the city attorney for the city of Truesdale.An attorney for Scheibe filed the lawsuit in Warren County Circuit Court Feb. 4, 2019. The suit alleges Scheibe sustained persistent injuries to his shoulders, knees and the spine of his upper back during a crash that occurred Feb. 6, 2014.The lawsuit states Scheibe was a passenger in Joyce’s vehicle during the crash. It alleges that as Joyce was driving on South Spoede Lane, he failed to stop at a stop sign at the intersection with the Interstate 70 South Outer Road. Joyce’s vehicle was hit by a vehicle driven by Darrell Meine, the lawsuit states.To include Meine in the court case, Scheibe’s lawsuit asserts that the man “lost control of his vehicle, crossed the center line of the roadway and struck the vehicle in which (Scheibe) was a passenger.”The suit accuses both Joyce and Meine of driving too fast, and failing to practice careful driving that might have prevented a collision.The lawsuit states Scheibe’s injuries have required medical treatment and will continue to require treatment in the future. He is seeking minimum damages of $25,000 each from the defendants.Presiding 12th Circuit Judge Jason Lamb is overseeing the case.A representative of Tim Joyce said his understanding is that the lawsuit is purely related to collecting insurance payments for Scheibe’s medical costs, and that the case was nearing its statute of limitations for that purpose.Scheibe was unavailable for comment as of press time.Scheibe is being represented by attorneys from Coyne, Cundiff and Hillemann in Lake St. Louis. The attorneys had not replied to a request for comment as of press time.No attorneys are currently listed for Joyce or Meine.Previous legal casesAnother lawsuit was previously filed by a passenger involved in the 2014 crash. Calvin R. Alberternst, 28, Wright City, was a passenger in Meine’s vehicle during the crash, according to a lawsuit filed in 2015.Alberternst sued Joyce for injuries allegedly caused by the crash, and Meine was later added as a defendant to the lawsuit. That suit alleged many of the same details as the current one, adding that Meine’s vehicle slid on ice while he was trying to avoid Joyce’s vehicle.Alberternst’s lawsuit was dismissed in January 2017 under stipulations submitted by Alberternst and Meine.Joyce also has been the legal representative for Scheibe or family members during at least two previous legal matters, according to court records. Between May 2013 and April 2014, Joyce was Scheibe’s attorney in a property dispute with one of Scheibe’s neighbors. That dispute was ongoing at the time Joyce and Scheibe were involved in the crash.Joyce also served as the attorney for the estate of Curtis W.
