Festus man charged with rape

Warren County prosecutors have charged a man for allegedly raping an unconscious woman earlier this year.

John T. Nelms, 32, of Festus, was charged Sept. 23 and arrested Sept. 28 on a single county of first-degree rape, stemming from an assault that allegedly occurred at a home off of Stringtown Road, north of Foristell.

According to charging documents, the reported victim in the case contacted the Warren County Sheriff’s Department to report an assault that occurred in May. The woman alleged to investigators that she had spent the day with Nelms and had been drinking. She told police that Nelms drove her back to her home, where she passed out.

The next day, the woman woke up to find that her undergarments had been removed. She alleged that she was later contacted by Nelms’ coworker, who claimed that Nelms had bragged about having sex with the woman after she passed out.

The victim told investigators that she confronted Nelms about the allegations, and that he apologized, but then allegedly made threats related to a personal consequence if she reported the incident.

Nelms is being held in custody at the Warren County Jail until he is seen by a judge. He had a hearing scheduled for Sept. 9 in front of Associate Judge Richard Scheibe.
