Prosecutors in St. Charles County have filed charges against a Warren County inmate who allegedly attempted to escape custody and fought to take a deputy’s firearm in September.Roman R. Fitzgibbons, 26, was arrested Sept. 17 on accusations of robbing a Warrenton woman at gunpoint. He now faces additional charges of second-degree assault on a special victim and attempted escape from custody while under arrest for a felony.Fitzgibbons is a former Warrenton resident. His most recent address is in O’Fallon.In charges filed Dec. 12, authorities allege Fitzgibbons assaulted a deputy and attempted escape the day after being arrested.Fitzgibbons had been transported to St. Joseph Hospital in St. Charles County for treatment. He was in the custody of a Warren County sheriff’s deputy, accompanied by a Lake St. Louis police officer.Fitzgibbons, who had his hands restrained in front of his body, asked to use the restroom. While in the restroom, Fitzgibbons reportedly called for the deputy to come in, then asked him to loosen the restraints.When the deputy refused, Fitzgibbons allegedly “lunged” at the him. The two struggled, during which police said Fitzgibbons tried to remove the deputy’s handgun from its holster.The deputy eventually gained control and restrained Fitzgibbons until help arrived.“Based on Fitzgibbons’ actions, it was believed that he was committed to escaping custody by any means possible, which included his attempt of a possible deadly force assault by trying to obtain the deputy’s handgun,” according to a probable cause statement seeking the charges against Fitzgibbons.Police said the deputy’s body camera engaged during the struggle and recorded Fitzgibbons struggling with the deputy and failing to comply with orders to stop fighting.Because the alleged assault was against a law enforcement officer, it is considered a class B felony punishable by up to 15 years in prison if he is convicted. Attempting escape is a class E felony that could result in up to four years in prison.Fitzgibbons already faced the possibility of several decades in prison for charges of first-degree robbery and armed criminal action, stemming from his initial arrest.He is currently being held at the Warren County Jail under a $150,000, cash-only bond. He has a hearing scheduled for Jan. 18 in Warren County Circuit Court. Fitzgibbons has no court date set in St. Charles County.Roman Fitzgibbons
