County sells properties to man who filed recent lawsuit over them

Two county-owned parcels sold for $5,210 in an auction Monday to a man who had filed a lawsuit over them 10 days earlier.Ernest C. Swan had the winning bid for both properties, with the highest bid going for $4,235 and the other for $975. The winning bids include administrative fees.The properties are located in Wright City on Veterans Memorial Parkway east of Oak Street and are adjacent to one another. Three mobile homes sit on one parcel, with one trailer on the second property, county officials said.Both of Swan’s bids were $1 more than what was offered by Peoples Bank and Trust, a move orchestrated prior to the auction. The bank, which is financially backing Swan in the transaction, placed bids on both properties since there was confusion on whether or not Swan owns other land in the county that has unpaid taxes.Should it be determined that Swan has unpaid taxes, Peoples Bank and Trust would be the winning bidder by default.No other bidders were in attendance. The starting bid for the properties was $4,233.27 and $973.88.The county acquired the properties during the back tax sale in August. According to county officials, Swan had not paid taxes on the two properties in seven years.On Feb. 11, Swan filed a petition in replevin against the county claiming that he owned the four mobile homes located on the properties. During Monday’s auction Swan’s attorney, Darryl Hicks, indicated that the lawsuit would be dropped once the ownership of the two properties is transferred to his client.Commissioners on Monday said the auction was believed to be a necessity since multiple parties had expressed an interest in purchasing the parcels.Auction
