County leaders in court dispute over tax bill

The Warren County Commission is taking a dispute with County Collector Julie Schaumberg to court.The commission is seeking a court order to require Schaumberg to waive late fees and penalties on a tax bill that she says her office never received payment for.The county collector is the elected official in charge of receiving and processing property tax payments.The taxpayer in this case came to the commission in February asking for relief from penalties on an $832 tax bill, according to a letter submitted with the court filing. The taxpayer told the commission she mailed a check to the collector’s office Dec. 29, 2017, two days before the deadline to avoid late fees.But Schaumberg maintains that no check was received for that bill, and the taxpayer therefore owed an 11 percent late fee, about $93. The taxpayer refused to pay the fee, saying in the letter that the collector’s office had made an error.After reviewing the taxpayer’s request, the commission issued a written directive for Schaumberg to waive the penalty on Feb. 13, according to the court filing.In a reply the same day, Schaumberg stated her office had not made an error and that payment must be made on the bill. She suggested that the commissioners could decide to issue a refund if they wished to do so.Presiding Commissioner Roger Mauzy said the county officials had tried to work out the dispute internally, but couldn’t come to an agreement.“There was a difference of opinion, and it’s going to take a court to make a determination,” Mauzy said.While the taxpayer is absolutely sure that she sent a check for the full amount of her bill, Schaumberg is just as certain that no check was lost and that her office thoroughly processed all of the mailed tax payments.Schaumberg described the entire situation as frustrating.“I have to be fair and impartial as the elected county tax collector, and appropriately apply the late payment penalty and interest laws,” Schaumberg said.A hearing on the dispute had been scheduled for May at the Warren County Circuit Court, but was postponed until a judge has been assigned to hear the case.
