County hears appeal on new Jackie O’s location

A group of nearby residents were not happy with the Warren County Planning and Zoning Board’s January decision to allow an auction house and resale shop along the North Service Road west of Wright City.That’s when they appealed the decision to the Warren County Commission.The commission met March 6 to hear both sides of the issue. Jackie Brown Oberlander and Jeff Oberlander, owners of Jackie O’s Consignment Gallery and Auction House, purchased agricultural property at 17467 N. Service Road and received a conditional use permit to build a 6,000-square-foot building that would become the new home of their business. There currently is an unused church building and other structures on the property.Also included in the permit was a plan to build rentable storage units on the 9-acre property. Jackie Oberlander said that would help pay for the significant investment they are making.An adjacent 9-acre plot to the north would be reserved to build a private residence, the Oberlanders said.Area residents protested the plans, raising concerns about noise from the auctions and fears about who and what would be in the storage units.“We hope they are successful. We’re not against them. We are pro-business ... but not at the expense of the property owners around them,” said Peter Bales, who filed a lengthy protest to the conditional use permit.Bales expressed concern that the storage units would attract criminals who could roam to other nearby properties, saying such a danger is inherent to storage facilities. They also feared lack of oversight would allow renters to illegally store chemicals that could contaminate a nearby creek.The Oberlanders said security concerns would be addressed by fencing, cameras and a keypad entry to track who comes and goes from the storage area. Tenants would be required to sign a document saying they would not store prohibited items or chemicals, and the storage units are designed to prevent liquid from escaping, Jackie said.Also troubling for nearby neighbors is the potential impact the business could have on the value and enjoyment of their properties. The noise and voices from outdoor auctions and events would disrupt the area’s quiet atmosphere, residents said.There already are several commercial properties along the North Service Road near where the Oberlanders have proposed building their business. Traffic from the service road and Interstate 70 also generates a large amount of noise, Jackie added.“We won’t be louder than that highway, I promise,” she said.Another protest related to the property’s septic capability was addressed by the county commissioners. All septic systems must receive approval from the county sanitarian’s office, and getting that approval is a condition of receiving a conditional use permit.Overall, residents argued that the area is not right for the business, that the property is for agriculture, not commercial use, and that the business would be better placed somewhere else.Jeff Oberlander firmly disagreed.“All the marketing research we did shows that spot will be a gold mine,” he said. “We had the University of Missouri Extension office do complete marketing research.”The county commission now is in the process of deliberating the arguments and deciding whether it will issue a new conditional use permit to the Oberlanders, with plans to visit their property March 20. Commissioners have the power to review, remove or add to the stipulations of the original conditional use permit. The permit included limits on the frequency of outdoor events and required all business to be contained within the southern 9-acre lot.They will hold another public hearing, likely in late March, to deliver their decision.Jackie O's
