A Warrenton man has been found guilty of rape and incest for actions reported in 2013.John P. Mahan, 46, could spend as many as 22 years in prison for engaging in a nonconsensual sexual relationship with a victim who was 17 years old at the time.A Warren County jury found Mahan guilty of second-degree rape and incest June 28. The incidents reportedly occurred at Mahan’s residence on Ridgewood Drive south of Wright City. The Warren County Sheriff’s Department was contacted and began an investigation in December 2013, according to the sheriff’s office.Warren County Circuit Court records indicate that Mahan was not charged with a crime until almost two years later, in October 2015.Mahan has been held in jail since his arrest on that charge. His attorneys asked for a bond reduction several times, but were denied.Prosecutor Kelly King said Mahan is a prior and persistent offender, and could therefore be sentenced to as much as 15 years in prison for the rape conviction. The incest conviction comes with a penalty of up to seven years, meaning Mahan could be sentenced to a maximum of 22 years behind bars, King said.Mahan is scheduled to be sentenced Sept. 5 at the Warren County Courthouse.This was not the first time Mahan was charged with sex crimes. Court records show Mahan was charged in 2011 in Franklin County for two charges of statutory rape and one charge of statutory sodomy. In that case, he was not taken into custody until October 2013, according to court records.In November 2013, the Franklin County Circuit Court reduced Mahan’s bond from $100,000 to $25,000 with a 10 percent cash or surety accepted. He posted bond in early December 2013, about two weeks before the rape and incest were reported in Warren County.Since then, Mahan’s case in Franklin County has been stuck in a series of continuances, with multiple trial dates canceled and postponed, according to court records.His case in Franklin County has been on hold while he is incarcerated in the Warren County Jail.
