Late in the evening of Sept. 10, Warren County Sheriff's Department Cpl. Jason Maskey was contacted by the victim stating that a detached garage on his rental property had been burglarized earlier that day.
The victim stated earlier on Sept. 10 he had observed a truck pulling a trailer leave his driveway and despite the suspects' efforts to elude him, the victim was able to catch suspects one, two and three. Suspect two was later identified as David Herndon, 48, of Warrenton.
The victim stated that Herndon pleaded with him not to call the police and returned the items, a Maytag dryer and a Hoyt crossbow worth approximately $3,300, with the victim and suspect one, according to the probable cause statement.
Maskey was able to identify Herndon after arresting suspect one, with information from suspect three and the victim was able to identify him in a photo lineup.
After Herndon was taken into custody Maskey reported Herndon admitted that he and suspect one entered the garage and stole the items, although he did not believe he had done anything wrong since they had returned them.
Maskey also reported that Herndon has an extensive criminal history including involvement in stealing and forgery, as well as the possession and distribution of illegal narcotics.
Herndon was arrested and charged with burglary in the second degree, a felony, and is currently being held without bond.
