Guilty verdict in assault that sent woman to hospital

A jury has convicted a Warren County man who was arrested in 2019 for fracturing a woman’s jaw and causing her a severe head injury.

Billy L. Wagner II, 46, of Marthasville, was convicted July 21 for first-degree domestic assault, delivery of a controlled substance and unlawful possession of a firearm. The charges stem from a September 2019 assault in which Wagner allegedly punched a woman unconscious, causing her to fall and strike her head on the floor.

The victim in the case called the Warren County Sheriff’s Department the same day to report the assault, and was taken to a hospital where she was diagnosed with a severe head injury, brain bleed, and fractured jaw. 

Deputies arrested Wagner at his home on Pries Place within hours of the assault. During the arrest, deputies found marijuana plants and materials for distributing drugs, along with a rifle that Wagner was not allowed to possess because he is a previously convicted felon.

Wagner’s trial lasted a total of three days, with jury selection beginning on July 19 and testimony and evidence delivered on July 20 and 21, according to court records. The jury went to deliberation for a little over an hour on the afternoon of the third day, before returning a guilty verdict. The trial was overseen by Presiding Circuit Judge Jason Lamb.

A sentencing hearing has been scheduled for Wagner on Sept. 9.
